act. first from fox this monday night, the senate majority leader harry reid and president obama himself breaking their silences on comments senator reid made about race back in 2008. and both men now say it's time to put all of this behind them. this comes after word broke of a passage in the new book "game change" about the last presidential campaign. in it, the authors write about senator reid, he was wowed by obama's oratorical gifts and believed that the country was ready to embrace a black presidential candidate, especially one such as obama a "light skinned african american with no negr dialect unless he wanted to have one." senator reid noted he supported for the president for a long time. for the first time since all of this happened both the senate majority leader and the president spoke publicly about it all. >> i apologized to the

president and to everyone that i could have used a better choice of words. >> this is a good man who has always been on the right-side of history. for him to have used some inartful language in trying to praise me and for people to try to make hay out of that makes absolutely no sense. >> shepard: and the president says there was nothing mean spirited in senator reid's comments. republicans are crying foul. the republican national committee chairman michael steele argues if senate minority leader mitch mcconnell said those very words this democratic chairman and this president would be calling for his head. he and other republicans say senator reid's apology just isn't enough. they say this was clearly just a bad choice of words. >> shannon: reid and the president are focusing on the civil rights record that he has got and hillary shelton of the

naacp, here is how he praised reid today. >> he fought for fairness and democracy for all americans regardless of race, gender or ethnicity and even put his career on the line to take courageous positions. >> shannon: not everyone is giving reid credit for that record in writing this off as a one-time mistake, including one of the republicans hoping to take reid's seat. here is what she said about other gaffes he made. >> he called allan greenspan a political hack and called president bush in the midst of a classroom in las vegas, callle him a loser and called the tea party folks protesting our washington policies, he is calling them evil mongers. >> shannon: the two sides have cheerly staked out positions. >> shepard: i'm guessing there are competing thoughts about how this could affect senator reid's election bid which the polls were quite shaky, the

polls were some of the worst ever for reid and they were taken before the controversial comments were made public. the latest development still no help but you have to remember, of course, in politics the vote is still 11 months away. democrats believe he willle hang on to the seat. >> shepard: some republicans are arguing there is a double standard in play because of what happened in 2002 with then senate majority leader trent lott but the democrats argue the situation are completely different. senator lott was appearing at a birthday party for senator strom thurman when made this comment. >> i want to say this about my state, when strom thurman ran for president, we voted for him and we're proud of it. [ applause ] >> and to the rest of the country would have followed our lead we wouldn't have had all of these problems over all of these years either. >> shepard: strom thurman was a segregationist and a dixiecrat

when ran in 1948. shannon, republicans say the two situations are very much the same. democrats argue senator reid's comments are not grounded in prejudice and at the time the republican president of the united states said the senator should go as well. >> shannon: the democrats say there is no way you could probably compare the two situations. here is what robert gibbs said about trying to equate reid's remarks to lotts. >> i would suggest they spend about 20 seconds reading a little history and figuring out that to draw that analogy strains any intellectual enterprise. >> shannon: from the other side of the aisle we have texas senator john cornen who said it is difficult to see the situation as anything other than a clear double standard on the part of senate democrats and others. democrats expressed outrage at senator lott and called on him

to step down as leader. the same standard should be applied to senator reid and his embarrassing and racially insensitive statements. >> shepard: shannon, good to see you, thank you. the fort hood incident. before it they questioned his confidence and behavior and questioned his highwayialty to our nation. but military doctors still gave positive evaluations of dr. nadalp.hasan. the report shows that doctors repeatedly voiced concerns about major nadal's attitude but continued to help him move up through the rank is. the report does not explain why they did that before he opened fire and killed 13 people in the worst shooting ever on a military base in america. live in the newsroom in new york tonight, what else does the pentagon review show, jonathan? >> most strikingly, according

to the associated press it focuses on a presentation major hasan gave during his residency in the walter reed medical center in 2007. it was a presentation on the wars in afghanistan and iraq. look at some of points major hasan made. he said the war on terror is a war on islam. secondly, he said that islamic law should trump the u.s. constitution. and finally, according to some present at the presentation he also tried to justify suicide bombings. you would think that those three points made by the major would be a huge red flag. apparently nobody pickd that flag up. >> shepard: not only left him in the military but kept promoting him. >> captain in 2003 and then to mager in 2009. the report apparently shows this is quite a common thread within the u.s. army, the desire to promote junior officers rather than to look

specifically at some of their actions that might raise these kind of red flags. clearly this is something that the secretary of defense will want to take a close look at when gets this report. we believe that will be on thursday. >> shepard: it is my understanding there may be some connections between that and the attempted christmas day plane attack? >> a similarity in the sense that officials clearly in both incidents have the information they needed to take action. but they apparently did not connect the dots. there is, of course, one tragic difference as well, that is that the attack on the detroit-bound plane fail today pull off his attack, tragically, though, major hasan was everybody's nightmare in terms of his success of his attack, killing 13 people. >> shepard: a new clue in the murder of a play boy model. tonight a look at surveillance video from her final hours. lawyer for her boyfriend says it proves he is innocent.

>> shepard: mark mcgwire. here is the shocker of the day, he has come clean about something baseball fans long suspected. he admits now he did use steroids even as he toppled the record for the most homeruns in a single game -- or a single season. he says i tried steroids in the '89 off season and then after i was injured in '93 i used steroids again and used them on occasion throughout the 1990s including during the '98 season. that is the season when hit what was then a homerun record of 70.

mcguire says he had good years and bad years when taking the drugs but "no matter what i shouldn't have done them and for that i'm truly sorry. mark mcgwire taking a different tone than he did during the congressional hearings on the use of stare during the hearings on professional payable. >> i'm not going to -- professional baseball. >> i'm not here to discuss that. i'm not here to talk about the past. >> he is now because now he wants a job and he says "i never knew when but i knew this day would come, it is time to talk about the past and confirm what people suspected." rick levinthal joins us now. we know now why. >> he is rejoining the st. louis cardinals as hitting coach and the whispers and allegations were not going away so he puts the rumors to rest and hopes to move forward. he said he had good and bad

years when didn't take steroids and did have good and bad years when did. he calls it foolish and a mistake and in a live interview he says he did oral steroids, injectable steroids and says he absolutely could have hit 70 homeruns without steroids. >> shepard: we will never know. he is now trying to get a job with the cardinals and if he didn't do this first it would come out later and that is why now, isn't it? >> the commissioner calls it another step in the right direction and all praising mcgwire for coming clean. if you look at a difference of h him between 1978 and 1988, the denver 1988 and 1998, the difference is striking. far from the 75% vote needed to get in. this could help him the admission but probably wouldn't

body burning in a dumpster may come again. this comes as new surveillance video shows paula in the hours before her death. she is the woman with the long blonde hair. the video shows her leaving a nightclub in the morning at 7:20 in the morning and a group of-leaving at the same time. investigators say she went to the club with her boyfriend but bouncers kicked them out when they got into a heated argument. he left at 7:00 a.m. and she left at 7:20 a.m. and police say the boyfriend returned to the hotel and they know he was there and now investigators are look for a man who followed her out of the club and of him we have no description. >> shepard: no where to hide and more trouble for the paramedic caught up in the scuffle with the state trooper last year. we reported on this as part of the no where to height series. the paramedic was bringing the patient to the hospital at the time and the fight was caught on camera.

he is on the u.s. government special global terrorist list. he denies links to terror and yemeni officials say they don't have evidence against him. his talk, however, is tough. >> is there any justification for the targeting or killing of americans in places where you deem they should not be, even here in yemen? >> what are you going to do if one invades you in your country and kill you? defending the lives and homeland is a must. >> the yemeni president raised some eyebrows just this past weekend saying in an interview that while his government was up to the challenge of al-qaeda that dialogue could be the best way. he did say that a talk could only happen if the al-qaeda members renounced terrorism. and even critics admit the government is now serious about dealing with the terror threat here. >> they have gone after them with resistance and a high rate of success and so far al-qaeda

has not been able to retaliate. >> we should not expect to see u.s. troops in any large numbers here in the near future. but we should expect to see more military funding. in fact, just in the past couple of days, it has been announced the funding would more than trouble this year, up to $150 million. that can't make that cleric happy either. >> shepard: greg live in sanaa in yemen. >> unmanned drones may be collecting so much intelligence in the war zone that military can't even keep up with it. air force drones gathered three times as much information in iraq and afghanistan as in all of 2007. right now, analysts watch the video feeds live and report warnings about road side bombs and insurgents down to the troops in the field but officials believe the archived videos could serve as a useful tool to study insurgent

report. bottom of the hour and time for the top of the news. president obama on a collision course with union leaders and democrats in a healthcare battle. the issue attacks on cadillac insurance plans included in the senate bill. it would apply to individual policies worth more than $8,000 and family plans worth more than $23,000. insurance companies would be charged a 40% tax on those plans. and critics say that will mean higher premiums or fewer benefits for patients. major garrett live at the white house. major, the president met with union leaders there today. what do we know? >> almost a dodds of the top labor leaders -- almost a dozen of the top labor leaders here at the white house. the white house said it was a productive meet bug no resolution of the enormous dispute with enormous policy and political implications. the president of the afl-cio says the senate tax falls disproportionately and he said

wrongly on working families. >> instead of taxing the rich the the senate bill taxes the middle class by taxing workers' health plans. not just union members' healthcare plans. >> he also went on to say that the plan in the senate pits those who have health indiana in the middle class against those who don't and he says that is the kind of class warfare labor unions reject. >> shepard: senator chris dodd said healthcare reform is hanging by a thread. is that the growing feeling on the hill that this is in jeopardy. >> he is a democrat and that is why the mint comments are so vy important. i talked to joe courtney who is leading the possible house revolt. he agreed though this is likely to pass it is in some degree of jeopardy. let's listen. >> the process is very precarious right now and i

think that both chambers have to approach it in a positive way but understanding there is real challenges that need to be fixed here. >> let me describe real challenges. 190, shepard, of the 256 house democrats opposed the senate tax approach and have yet to say they will vote against it in the final compromise but it might be moving in that direction. >> shepard: major, thanks. new york city, the city that banned smoking from the restaurants and then transfats for everybody and required all chain restaurants to post calorie information on everything is now going after its latest target. salt. the city released new guidelines for packaged foods now and here is a example. over next five years the city asking food manufacturers to lower sodium in breakfast cereals by 39%. 38% in canned vegetables. 30% in salad dressings.

reported $36 million salary. >> shepard: and he could make more on this. i don't understand the differences between that singing competition and what he is bringing here and the one we have now. >> he will be the executive producer of this show and there he can make more money and this show doesn't have an age limit so people of all different ages compete and the judges mentor the contest yans sants so lookr that. the show comes to fox in 2011 and he will be featured more prominently as he is mentoring the contestants as well as judging them. >> and it can also affect "american idol's" ratings. we expect tomorrow's show to get a boost from all this publicity the day before idol returns. other networks are talking about the rating is, yes, it has gone down some in the past few years but still remains the number one show on television. simon wants to go out while it is number one. and is hoping his new show

one of the passengers described the landing earlier today on studio b. >> 100 feet or so above the ground he announced brace. the flight attendants started yelling brace, brace, brace. then i believe he cut the power on the plane for the last 50 feet because i guess they didn't want anything electrical if there. i swear it was one of the smoothest landings i have been on. came down on the left site and we slid to the right-side. >> shepard: the landing damaged part of the fuselage but nobody was hurt. >> newark had a scare when a man slipped by security in terminal c. incidents like that one and the attempted bombing on christmas day sparked a renewed interest in airport screening and now one georgia company says it has a better way to scan baggage. a issues system that could detect threats in things like

the consumer product safety division launches an investigation. it is called cadmium and it is found in toy jewelry found in places like wal-mart and dollar store chains. cadmium is more dangerous than lead and has been linked to kidney, bone and joint damage. an independent lab found cadmium in 12% of 103 jewelry items tested, many made in china including rudolph the red nosed reindeer charms like the one here sold in dollar stores in new york. cadmium is not outlawed in children's toys and jewelry here in the united states. gay marriage a hot topic in a california courtroom now and cameras catching all the action but the supreme court says regular folks may never get to see the footage. we will tell you why. plus, we just received a message from planet blago. >> what i said was stupid, stupid, stupid.

>> shepard: one federal courtroom in san francisco is now the focus of two hot button issues. gay marriage and cameras in the courtroom. the federal courts generally ban cameras but a federal judge last week made an exception for a challenge to california's voter approved ban on same-sex marriage. he ruled video of the trial can be streamed on you tube. but just hours before the trial started, this morning, the united states supreme court blocked those plans at least for now. claudia cowen is following the trial and is live outside the courthouse tonight. what is the rub here? >> cameras were rolling in the courtroom today but the nation's highest court says it
